Terms & Conditions
Yacht+ is a DBA (“doing business as”) of **Harbor Brokerage Group, LLC, a Tennessee limited liability company. All references to “Yacht+,” “we,” “our,” or “us” refer to Harbor Brokerage Group, LLC and its affiliates. By purchasing a Yacht+ device, activating a membership, or using any Yacht+ service, you agree to the following Terms & Conditions.
1. Device Requirement
1. All Yacht+ Memberships (Monitor, Priority, Premier) require a one-time purchase of an approved Yacht+ monitoring device.
2. Memberships cannot be activated or maintained without a functioning and installed Yacht+ device.
3. Device purchases are non-refundable and not eligible for return or credit.
2. Subscription Terms
1. All monthly Yacht+ Memberships require a 12-month minimum commitment
2. Early Cancellation:
If cancelled before the end of the 12-month term, the **remaining balance for the full 12 months is immediately due.
3. No Refunds: Subscription payments are non-refundable, including partial months, unused service, system downtime, or early cancellation.
4. Yearly Memberships
Paid in full upfront, non-refundable, and cannot be prorated for early cancellation.
3. Installation & Connectivity
1. Devices must be installed by Yacht+ personnel or approved installers.
2. Installation includes activation and connectivity setup.
3. Yacht+ is not responsible for:
* poor cellular coverage,
* low voltage or dead batteries,
* disconnected wiring,
* GPS interference,
* customer modification of the device,
* environmental conditions affecting service.
4. Authorization to Board & Install
By purchasing a Yacht+ membership and monitoring device, the customer grants Yacht+ and its authorized technicians permission to board the vessel without further notice for the purposes of installation, activation, inspection of mounting locations, and verification of system function. Yacht+ technicians are authorized to install the monitoring device in any location on the vessel they determine to be the most suitable for signal strength, access, safety, and system performance. The customer acknowledges that device placement is a technical decision made by Yacht+ and agrees not to dispute or require relocation of the device unless necessary for safety or system reliability.

4. Service Area
1. Priority & Premier memberships include mobile service within the defined Knoxville coverage radius.
2. Service outside this area may not be available or may incur additional fees.
3. Yacht+ may decline membership or mobile service for vessels outside the service radius.
5. Customer Responsibilities
Customer agrees to:
* maintain vessel battery systems and wiring,
* ensure device remains connected and powered,
* notify Yacht+ of electrical changes,
* allow vessel access for installation and service,
* ensure the vessel is safe, seaworthy, and structurally sound.
*Customer is solely responsible for the condition, seaworthiness, safety, and maintenance of the vessel, its batteries, wiring, and electrical systems. Yacht+ does not inspect or verify vessel condition.
6. Notifications & Monitoring
1. Yacht+ notifications are informational only and rely on third-party networks and sensors.
2. Yacht+ is NOT an emergency service provider.
The system does not contact 911, law enforcement, fire departments, marinas, towing companies, or emergency responders.
3. Customer is solely responsible for responding to alerts and taking action.
4. Yacht+ is not an insurance provider and the monitoring system is not a substitute for proper maintenance, storage, supervision, or insurance coverage.
7. No Guarantee of Prevention
Yacht+ devices and monitoring do not guarantee prevention of:
* theft,
* fire,
* flooding,
* sinking,
* battery or electrical failure,
* mechanical damage,
* unauthorized access,
* environmental damage.
The service is intended to provide notifications—not guaranteed protection.
8. Mobile Service Liability
Yacht+ is not responsible for:
* damage to docks, lifts, vehicles, trailers, or property during mobile service visits unless caused by proven gross negligence
* delays in service scheduling,
* inability to access the vessel due to marina restrictions or customer availability.
9. Limitation of Liability
To the fullest extent permitted by law:
1. Yacht+ and Harbor Brokerage Group, LLC are not liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to:
* vessel damage or loss,
* property damage,
* lost revenue, downtime, or economic loss,
* personal injury,
* missed alerts or system errors.
2. Yacht+ is not liable for service interruptions caused by:
* cellular network failures,
* GPS outages,
* server downtime,
* environmental interference,
* manufacturer defects,
* or third-party system issues.
3. Total liability is capped at the total membership fees paid in the prior 12 months.
4. All devices and services are provided on an “as-is” and “as-available” basis, with no express or implied warranties, including any implied warranties of merchantability or fitness for a particular purpose.
10. Indemnification
Customer agrees to indemnify, defend, and hold harmless Yacht+ and Harbor Brokerage Group, LLC from any claims, damages, or losses arising and any costs or attorney fees associated with such claims.from:
* failure to maintain the vessel or electrical systems,
* failure to act on notifications,
* customer negligence,
* unauthorized device removal or modification,
* unsafe or hazardous vessel conditions,
* misrepresentation of vessel information,
* use of the service outside intended purposes.
11. No Transfer of Service
Memberships and device activations are non-transferable without written approval.
Device must be reactivated for new ownership and may require new installation or subscription fees.
12. Cancellation Policy
1. Memberships can be cancelled at any time.
2. If cancelled before the 12-month commitment ends, the remaining balance is due immediately
3. No refunds or credits for unused months or device purchases.
4. Services terminate upon cancellation or non-payment.
13. Termination by Yacht+
Yacht+ may suspend or terminate service for:
* non-payment,
* abuse of service,
* fraudulent activity,
* device tampering,
* safety concerns,
* vessels located outside the coverage area,
* violations of these Terms.
14. Changes to Terms
Yacht+ may modify these Terms at any time. Continued use of the device or service constitutes acceptance of updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Tennessee. Any disputes shall be resolved in Tennessee courts.
16. Agreement to Terms and Conditions
By purchasing a Yacht+ device, activating a membership, or submitting payment for any Yacht+ subscription, you confirm that you have read, understand, and agree to be bound by all Yacht+ Terms & Conditions, including but not limited to membership requirements, device policies, installation procedures, automatic renewals, billing terms, and cancellation policies.
